On January 1, 2016, Federal Law No.224-FZ “On Public Private Partnerships, Municipal Private Partnerships in the Russian Federation and Amendments to Certain Legislative Acts of the Russian Federation” dated July 13, 2015 was enacted. The federal law is a law of direct action; it regulates the entire life cycle of public private partnership projects in a detailed manner. 14 normative legal acts of the Russian Federation were also adopted for its development.
In order to ensure its implementation in the territory of the Samara Region, the necessary legal and regulatory framework regulating the work of the executive authorities of the region in detail was developed. Under these conditions, the legislative procedure for the enforcement of agreements on PPP business became more transparent, many property risks in the implementation of such projects were removed.
A public private partnership is a mutually beneficial relationship between an entrepreneur and the government institution. Such partnerships are created to perform the work on construction or modernization of production and social infrastructure. The cooperation is voluntary and does not imply arbitrary interference of the state with business affairs. Its objective is to achieve a mutually beneficial effect.
Property participation of the region in projects based on PPP principles, is carried out by providing land plots owned by the region, where the PPP agreement objects are or will be located, for gratuitous use by a private partner, under a lease agreement or equity participation in the authorized capital of joint stock companies.
The main areas of use of public private partnerships in accordance with the Social and Economic Development Strategy of the Samara Region for the Period up to 2020 are transport infrastructure projects, housing projects, social infrastructure projects (health, education, culture, etc.). Initiators of implementing such projects are both the authorities and private entrepreneurs.
According to the experts, the investment legislation of the region providing investors with a wide range of support is considered one of the most progressive in the country.
Financial participation of the Samara Region in projects based on PPP principles is implemented through the provision of regional budget funds in the form of budgetary investments to legal entities and individual entrepreneurs.
The greatest progress in the PPP mechanisms application in the Samara Region has been made in the health care sector. For example, 13 PPP projects creating about 1 700 new jobs and attracting more than 133.334 million euro of investments are now in progress.
In November 2015, the Samara Region was included in the top three in the category “The best social sphere PPP project” with the project for the construction and operation of a separate body of the Center of Extracorporeal Blood Correction and Clinical Transfusion in Samara within the framework of ROSINFRA Award. And in December 2015 The Samara Region won the All-Russian “The best Russian region in terms of development of public-private partnership in the health sector” competition.
